On the Police Enterprise Collaborative Model of Electronic Data Retrieval

Abstract:

The entrusted verification model of "investigating authorities issuing orders and network platforms executing them" hinders the efficient and legal retrieval of electronic data, and the police enterprise collaborative model has emerged. However, the practice of electronic data retrieval under the collaboration of police and enterprises faces obstacles such as data security risks, regulatory failures, and loss of platform profitability, resulting in insufficient power regulation and protection of rights. In this regard, it is necessary to follow the concept of "organic combination of rule of law and technology" to improve the collaborative model between police and enterprises: at the institutional level, clarify data classification for procedural regulation, establish data prosecutors for neutral supervision, standardize data transactions to protect platform rights and interests; At the technical level, blockchain technology ensures the trustworthiness and security of electronic data retrieval.
