Research on the Ownership and Protection Path of Agricultural Scientific Observation Data

Abstract:

Agricultural scientific observation data, as an information carrier of factor changes in the agricultural production system, is a strategic resource for promoting high-quality agricultural development and modernization of agriculture and rural areas. Its basic supporting role in agricultural technology innovation and policy system creation is increasingly prominent. In the face of bottlenecks such as complex production of agricultural scientific observation data, diverse data subjects, and scattered data storage, it is of great theoretical and practical significance to scientifically define the ownership of agricultural scientific observation and accelerate the construction of a comprehensive policy and technical support system. The article comprehensively reviews the current status of the governance system for agricultural scientific observation data, systematically analyzes the major challenges faced by data governance, summarizes the difficulties faced in data ownership and protection, divides the ownership types of agricultural scientific observation data, and puts forward suggestions for the protection of agricultural scientific observation data. From the perspective of the rights and interests among data producers, managers, and users, the ownership of agricultural scientific observation data can be divided into data ownership, data production rights, data use rights, data publishing rights, and data trading rights. In response to the pain points and difficulties of stakeholders' unwillingness, fear, and inability in open sharing, optimizing the protection environment for agricultural scientific observation data in China, actively promoting the construction of a national level data sharing platform certification and authorization system, guiding and incentivizing the publication of agricultural scientific observation data, accelerating the promotion of China's scientific and technological resource identification applications, and exploring the construction of a closed data circulation technology system are effective ways to improve data utilization and optimize data resource allocation. They are also effective methods to accelerate the improvement of laws and regulations for intellectual property protection of agricultural scientific observation data that are in line with national conditions, and effective measures to orderly promote the integration and open sharing process of data resources.
