Research on the Protection of Labor Rights and Interests of Retirees in Reemployment

Abstract:

With the aggravation of aging in China, many retirees choose to reenter the workforce after retirement, which has become a relatively common labor phenomenon. Reemployment of retirees meets their social needs and also alleviates the pressure on social pension systems. However, there is a lack of legal protection for retirees' employment in China, and the current labor law even excludes retirees from its scope of protection. Retirees are in a vulnerable position in labor relationships, and issues such as employment discrimination, unequal pay for equal work, and difficulties in seeking relief for work-related injuries are not uncommon. The legal protection status of retirees is concerning. In response to the large-scale trend of retirees' employment, China needs to improve relevant legislation, clarify the legal status of retired workers, their legal relationship with employers, reasonably regulate employment discrimination against retired workers, improve work-related injury relief, etc., to safeguard the labor rights and interests of retirees and create a fair employment environment.
