Copyright Governance of Generative AI Art: Balancing Technological Innovation and Rights Protection

Abstract:

Generative AI technologies centered on deep learning and diffusion models have driven disruptive innovation in the digital art industry, while triggering global copyright dilemmas. The case of Getty Images v. Stability AI reveals typical conflicts: unauthorized use of copyrighted images for model training, unlicensed replication of artistic styles, and unclear originality and copyright attribution of AI-generated works. The traditional human-centered copyright system struggles to adapt to AI-driven creation, exacerbating disputes and originality crises. This paper reviews research progress and industrial dilemmas, compares cross-jurisdictional regulatory practices, and constructs a three-dimensional collaborative system consisting of awareness cultivation, legal improvement, and technical supervision. Specifically, legal improvement clarifies the compliance norms of AI model training data, technical supervision realizes standardized identification and traceability of AI generated content, and awareness cultivation, together with legal and technical guarantees, completes the right remedy mechanism for original creators. It aims to balance technological innovation and rights protection, providing theoretical references and feasible paths for resolving copyright disputes and promoting the sustainable development of the AI art industry.
