Abstract：

Scientific data is the most basic and active technological resource in the information age, and scientific data sharing is an inevitable trend of development. Implementing scientific data sharing can save social resources, avoid duplicate labor, and verify existing scientific research, which has important practical significance and urgent social needs. Intellectual property protection, as a prerequisite for scientific data sharing, plays a crucial role in promoting the orderly utilization of scientific data and providing a continuous stream of innovation for technological development. It is a fundamental issue that urgently needs to be addressed to achieve scientific data sharing. This article mainly adopts methods such as literature research and comparative analysis to analyze relevant literature on scientific data and intellectual property topics at home and abroad in recent years. Based on summarizing the current status of intellectual property protection in scientific data sharing in China, the relationship between scientific data sharing and intellectual property rights is explored, and the main problems in intellectual property protection faced by scientific data sharing are extracted: data property rights and the determination of ownership are the basis for the allocation of application rights in scientific data sharing. Currently, the ownership of scientific data property rights in China is unclear, there is a lack of recognized property rights solutions, a lack of unified policy guidance, weak awareness of intellectual property protection, and insufficient motivation for scientific data publishing. In response to these issues, intellectual property protection measures for scientific data sharing have been proposed: clarifying the ownership of scientific data property rights and balancing the interests of all parties involved; Establish a government guidance mechanism and fully leverage the role of the government; Promote the publication of scientific data and standardize the citation of scientific data; Intellectual property protection technology support for innovative scientific data sharing. In order to build a good data sharing environment and protect the legitimate rights and interests of data producers.
